Spain licenses online gambling in two layers under Ley 13/2011: a general licence for each modality, valid 10 years and renewable for 10 more, and singular licences for each game type. Getting in is the hard part, because general licences are granted only when a ministerial order opens a call (convocatoria). Real Decreto 520/2026 added two changes this year: the guarantee per general licence rises from €2,000,000 to €2,600,000 on 1 January 2027, and a cross-operator cap on player deposits follows in March 2027. The DGOJ register lists 77 licensed operators.

Online gambling in Spain is regulated by Ley 13/2011 of 27 May, in force since 29 May 2011, with its consolidated text last updated on 31 December 2022; Real Decreto 1614/2011 is the licensing regulation. The DGOJ, attached to the Ministry of Social Rights, Consumption and 2030 Agenda, licenses and supervises from Madrid. Licensing has two layers. A general licence covers a modality - Apuestas (betting), Otros juegos (other games) or Concursos (contests) - and runs 10 years, renewable for 10 more (art. 10). It is granted only through a public call, a convocatoria opened by ministerial order, and anyone interested may ask for a new call once 18 months have passed since the previous one. Singular licences then cover each game type, such as fixed-odds or exchange betting, slots, roulette, poker or bingo, for one to five years (art. 11). Lotteries stay with SELAE and ONCE.

Entry is heavy and about to get heavier. The applicant is a sociedad anónima whose sole purpose is gaming, seated in the EEA, with a permanent representative in Spain and €100,000 of share capital (€60,000 for contests only). A betting or other-games licence needs a guarantee of €2,000,000 for the initial period (contests €500,000), then €1,000,000 combined in later years. RD 520/2026 of 24 June 2026 lifts those amounts to €2,600,000 and €1,300,000 on 1 January 2027, and adds a joint deposit limit that follows each player across all licensed operators: €700 a day, €1,750 a week and €3,300 over four weeks by default, checked before every deposit from late March 2027. TV and radio ads were already limited to 01:00-05:00, save for the exceptions in art. 18 RD 958/2020, and shirt sponsorship is banned. The DGOJ must resolve an application within 6 months of filing, plus the time its own requests take. Its register lists 77 operators.

Singular licences sit under the general licence: fixed-odds and exchange betting, slots, roulette, blackjack, poker, bingo. General-licence holders apply for them outside the calls, for one to five years, with guarantees set as a share of the previous year's revenue.

Company form - a sociedad anónima or equivalent, domiciled in the EEA, whose sole corporate purpose is organising, marketing and operating games (art. 13).

A single rate since 2018

Ley 6/2018 rewrote art. 48.7 Ley 13/2011: the impuesto sobre actividades de juego applies one rate to net revenue for every game except state sports betting and promotional draws. We confirm the current percentage in your quote.Confirmed in the quote.

Net revenue, defined

The base is stakes minus prizes paid. Where the operator earns commissions, as in exchange betting, the base is the commissions plus related service charges.Stakes minus prizes.

The regions' share

The tax is state-wide, but revenue from residents' play goes to the autonomous communities in proportion to what their residents stake (art. 48).By residents' stakes.

Ceuta and Melilla

What licences does the DGOJ issue?+

When can I apply for a general licence?+

Only while a call is open. General licences are granted solely through a public convocatoria opened by ministerial order, and interested parties may request a new one 18 months after the previous call. We confirm the call status with the DGOJ before you commit budget.

What guarantee does Spain require?+

Can a foreign company apply?+

Yes, with Spanish or EEA nationality and at least one permanent representative in Spain (art. 13). For a general licence it must be a sociedad anónima whose sole purpose is gaming, with €100,000 of share capital.

What are the advertising rules?+

Tight. Under RD 958/2020, TV and radio gambling ads may run only between 01:00 and 05:00, with the exceptions in art. 18, and shirt sponsorship is banned (art. 12). The Supreme Court annulled the new-customer promotion and celebrity rules in April 2024.

Spain or Portugal for an Iberian launch?+

Portugal is easier to enter: it licenses on application, with €600,000 in guarantees against Spain's €2,000,000. Spain gives more back - a 10-year term against three years and 77 licensed operators against 19. If no Spanish call is open, Portugal is the file you can submit now.
