Belgium in brief

A licensed market with the doors already taken.

Belgian gambling runs on the Act of 7 May 1999 on games of chance, betting, gaming establishments and the protection of players, and it starts from a ban: under art. 4 §1 nobody may operate a game of chance without a licence granted in advance by the Gaming Commission. The Commission is chaired by a magistrate, seats representatives of six ministers, and grants licences, issues warnings, suspends, withdraws and fines. Art. 25 sets the classes - A casinos, B gaming halls, C cafés, D staff, E suppliers and online platform providers, F1 betting organisers, F2 bet-takers - and allows online play only as a supplement: A+, B+ and F1+. Only an A licensee may apply for A+, only a B licensee for B+, only an F1 licensee for F1+. A supplementary licence runs as long as its land licence: 15 years for A, 9 for B and F1. Servers must sit in a permanent establishment in Belgium (art. 43/8).

Then the closed doors. There are at most 9 class A licences - four in Flanders, four in Wallonia, one in Brussels - and the Commission states that all 9 are granted. There is currently no possibility to apply for a B licence (maximum 180) or an F1 licence. A newcomer therefore enters by acquiring an existing licensee, by partnering with one as the E-licensed platform provider that every A+, B+ and F1+ applicant must name, or by waiting for a vacancy. The guarantee is €75,000 for B+ or F1+; for casinos it is €250,000, and we confirm whether it attaches to A or A+. Online play pays the regional games and bets tax at 11% in Flanders and Wallonia. The Act of 18 February 2024 raised the minimum age for all play to 21, live online since 1 September 2024, and stopped supplementary licences of different classes from sharing a domain.

Can a new operator get an online gambling licence in Belgium?+

Not directly. Online licences are supplements - A+, B+, F1+ - and only holders of the matching land-based A, B or F1 licence may apply. All 9 A licences are granted and the Commission currently takes no B or F1 applications, so entry runs through an existing licensee.

How does the acquisition route work?+

You buy, or buy into, a company that holds an A, B or F1 licence, and that company holds or applies for the matching + licence. Due diligence covers the remaining term, the guarantee, the servers and the sanctions history before any price is agreed.

What is the partnership route?+

Becoming the E-licensed platform partner of an existing licensee. Every A+, B+ and F1+ applicant must name the E licensee that provides and maintains its platform; the E licence runs 10 years with a €25,000 guarantee for online services.

What guarantees apply?+

€75,000 for B+ and €75,000 for F1+. For casinos the guarantee is €250,000, and we confirm whether it attaches to A or A+. For E, €25,000 covers third-party repair and online services, or €12,500 per 50 machines for suppliers.

How long do licences run?+

A and A+ 15 years, B and B+ 9 years, F1 and F1+ 9 years, E 10 years, all renewable. A supplementary licence runs for the same period as its land licence and is renewed with it.

How is online play taxed?+

Regionally: 11% of stakes minus winnings paid in Flanders and in Wallonia, against 15% for land-based betting. We confirm the Brussels-Capital rate and the yearly Commission contribution before quoting.

Where must the servers be?+

In a permanent establishment on Belgian territory (art. 43/8), with a permanent data link between the website and the Gaming Commission. The application names the server address.

What player rules apply?+

Minimum age 21 for all online play since 1 September 2024, a limit on online play of EUR 200 per week per player, EPIS exclusions online and offline, and no paid social-media advertising under the Royal Decree of 27 February 2023.

Belgium or the Netherlands for a Benelux operator?+

The Netherlands, if you need a licence you can apply for: one Koa licence, a €61,300 fee, €50,000 security and a 6-month statutory clock. It costs more to run - 37.8% of GGR from 1 January 2026 against Belgium's 11% - and Belgium still needs a licensee to buy into.
