Romania in brief

A Romanian seat and a €1.2 million floor.

Romanian gambling law is Government Emergency Ordinance (OUG) 77/2009 (MO no. 439/26.06.2009), read with its methodological norms in HG 111/2016. The National Gambling Office (ONJN), created by OUG 20/2013, decides through its Supervisory Committee. Every online operator holds two instruments: a licence valid ten years, individual and non-transferable (HG 111/2016 art. 10(1)), and an operating authorisation valid 12 months (art. 10(2)). The Class I licence covers the remote games of art. 10(1)(i)-(n) - casino, fixed-odds and mutual betting, betting exchange, bingo, keno and tombola-type games - for operators with a direct contract with the player. Class II covers the supply side: platform hosting, payment processing, software, affiliates and testing bodies. OUG 82/2023 (MO no. 905/06.10.2023) raised the fees and limited remote gambling to companies registered in Romania or acting through a Romanian permanent establishment. Law 107/2024, in force since 28.04.2024, approved it with amendments.

The money sits in the OUG 82/2023 annex. A Class I operator pays €300,000 a year for the licence, an authorisation fee of 21% of gambling revenue with a €400,000 minimum, and €500,000 a year towards the ONJN's responsible-gambling work: at least €1.2 million before revenue above the minimum counts. A Finance Ministry order of April 2026 refers to an increase of gambling-related taxes, so we confirm the current rate with the ONJN before quoting. Since 1 January 2025 the guarantee is flat at €2,000,000, or €5,000,000 for online casino. Share capital is RON 1,000,000, and a safety server keeps Romanian player, game and transaction data where the operator cannot change it. Lotto stays a state monopoly. Suppliers carry their own risk: under Law 107/2024 a Class II holder that serves an unlicensed operator reachable from Romania loses its licence automatically.

OUG 77/2009 splits the market by who faces the player. Class I is the B2C licence with a direct player contract; Class II covers hosting, payments, software, affiliates and testing for Class I operators, and since Law 107/2024 it may serve no unlicensed operator reachable from Romania.

Withheld at every withdrawal

For remote gambling the operator withholds the tax at each transfer from the gaming account to the player's bank account and pays it by the 25th of the next month. The tax is final.At each withdrawal.

What licences does the ONJN issue for online gambling?+

Class I for remote-gambling operators with a direct contract with the player, and Class II for the supply side: platform hosting, payment processing, software, affiliates, auditors and testing bodies. Remote lotto sits under Class 3, reserved for the state lottery.

What does a Class I licence cost?+

€300,000 a year for the licence, an authorisation fee of 21% of gambling revenue with a €400,000 minimum, and a €500,000 annual contribution - at least €1.2 million a year. Add RON 1,000,000 of share capital and a €2,000,000 guarantee, or €5,000,000 for online casino.

How large is the guarantee?+

Can a foreign company hold a Romanian licence?+

Only through Romania: OUG 82/2023 limits remote gambling to companies registered in Romania or operating through a Romanian permanent establishment. An EU group can use a permanent establishment instead of a new company; we set up whichever fits the tax model.

What changed for players on 1 August 2025?+

The winnings tax. Under Fiscal Code art. 110 as rewritten by Law 141/2025, winnings up to RON 10,000 pay 4% instead of 3%, then RON 400 plus 20% up to RON 66,750, then RON 11,750 plus 40%. Operators withhold it at each withdrawal.

What does Law 107/2024 mean for suppliers?+

A Class II supplier that serves an unlicensed operator whose platform is accessible from Romania loses its licence automatically, and joint operation is allowed only between Class I and Class II holders. Fines run from RON 150,000 to RON 200,000.

How long does licensing take?+

We confirm the current timetable with the ONJN per case; the licence and each 12-month authorisation pass its Supervisory Committee. With the seat, the guarantee and the servers built first, plan for 6-12 months end to end.

Is the 21% rate final for 2026?+

21% with a €400,000 minimum is the rate in OUG 82/2023. In April 2026 a Finance Ministry order referred to an increase of gambling-related taxes without naming the act, so we confirm the current rate with the ONJN before quoting.

Romania or Hungary for a casino-and-betting operator?+

Hungary does two things better. The SZTFH decides on a 120-day statutory clock, and EEA companies apply directly with registered representation. Romania wins on product: Class I covers online casino, which Hungary keeps tied to land-based concessions, and the entry bills differ in shape - €1.2 million a year here, a HUF 600 million fee for up to seven years there.
