Italy reorganised online gambling with D.Lgs. 41/2024 and now sells access by tender: ADM awards each remote-gaming concession through a public procedure, for at most nine years and with no renewal. The price is €7 million per concession - €4 million at award, €3 million when play starts - plus an annual fee of 3% of net margin. Applicants need €3 million of gaming revenue over the last two years. A group may request five concessions at most.

Italy's remote gaming runs under D.Lgs. 25 marzo 2024, n. 41, the reorganisation decree adopted under the 2023 tax delegation law (L. 111/2023, art. 15) and in force since 4 April 2024. Its Title II sets the concession relationship: articles 6-11 cover the requirements and duties of concessionaires, articles 12-13 the telematic network and top-up points. ADM, the customs and monopolies agency, awards the concessions. One concession covers the whole remote catalogue in art. 6 c.1 - fixed-odds and totalisator betting on sports, horse racing and simulated events, pools, national horse-racing bets, skill and card games, fixed-odds games, player-to-player betting and bingo. Numerical games and lotteries stay with separate single concessionaires. The door is narrow. Under art. 6 c.3, ADM grants concessions only at the end of a public tender, for at most nine years, and renewal is excluded.
The economics are written into the decree. Each concession costs €7 million one-off: €4 million at award and €3 million when play starts, at the latest six months after the concession is issued. On top come an annual fee of 3% of net margin, paid in two halves by 16 January and 16 July, and a responsible-gaming contribution of 0.2% of net revenue, capped at €1 million a year. A group may request five concessions at most, each tied to one website on the national domain that cannot be lent to third parties. Applicants must be EEA capital companies with €3 million of gaming revenue over the last two financial years and their technical infrastructure inside the EEA. Gaming taxes did not move: art. 23 c.2 leaves them unchanged until a land-based reform. Advertising has been banned outright since D.L. 87/2018, with fines of 20% of the deal value and at least €50,000.

Taxation of gaming operators in Italy.
D.Lgs. 41/2024 changed the concession, not the taxes: remote-gaming levies stay as they were until a land-based reform.

How do I get an online gaming licence in Italy?+
Through an ADM public tender. Art. 6 c.3 of D.Lgs. 41/2024 lets ADM grant remote-gaming concessions only at the end of a public procedure, for at most nine years with no renewal. We confirm the status of the current procedure with ADM when we scope your file.
What does a concession cost?+

As before the reform. Art. 23 c.2 of D.Lgs. 41/2024 left remote-gaming taxes unchanged pending a land-based reorganisation. We confirm the rate for each product before quoting, and the 3% concession fee comes on top.
Can we advertise?+
No. D.L. 87/2018 art. 9 bans any form of gambling advertising, direct or indirect, on any medium, and sponsorship since 1 January 2019. The fine is 20% of the deal value, at least €50,000, and media owners and event organisers are liable too.
Which player-protection tools are mandatory?+
Art. 15 c.1 lists them: self-limits on time, spend and losses, ADM-approved deposit limits, automatic alerts, self-exclusion by product category, contact channels at least 5 days a week and 8 hours a day, and certified risk monitoring.
Italy or Spain for a betting and casino group?+
Spain costs less to enter - a €2,000,000 guarantee (€2,600,000 from 2027) against Italy's €7 million price - and its general licence renews for 10 more years, while Italy's concession ends after nine. Italy puts the whole remote catalogue under one concession. Both open only by call or tender.
