Jersey in brief

Forex license in Jersey: low capital, high demands on people and track record.

Jersey has no forex or CFD licence by that name. The JFSC registers a broker under the Financial Services (Jersey) Law 1998 to carry on investment business, and Art. 2(2)(a) defines the relevant part: buying, selling, subscribing for or underwriting investments as principal or agent, or arranging such deals for someone else. Options, futures and contracts for differences are listed in Schedule 1 (paras. 6-8); whether a given rolling spot FX contract falls there is confirmed against Schedule 1 for the product list. The Financial Services (Financial Service Business) (Jersey) Order 2009 (R&O.74/2009) files the activity as Class A, dealing in investments. Art. 7 reaches far. Nobody may carry on the business in or from within Jersey unregistered, a Jersey company needs registration even for business done wholly abroad, and the offence carries up to 7 years' imprisonment, a fine, or both.

The capital is small. The Code of Practice for Investment Business, effective from 17 January 2022, asks £25,000 of paid-up share capital, net assets of £25,000 at all times and adjusted net liquid assets of at least 110% of the Total Requirement. The demanding part is people. The JFSC's licensing policy of December 2010 starts from a 3-year record as a supervised firm, the applicant's own or its immediate parent's, and the Code's "six eyes" rule puts three locally based individuals at the head of any firm allowed to control clients' assets. Non-executives do not count. The compliance officer must be based in Jersey. The service standard for a full application is 20 working days, down from 30 since 10 June 2026, and longer for complex files. A registered investment business then pays 10% tax, not the island's 0% standard rate.

A JFSC registration for Class A investment business under the 1998 Law: £25,000 paid up, £25,000 of net assets, liquid assets of at least 110% of the Total Requirement, and a 20-working-day service standard.

The JFSC starts from a 3-year supervised track record. Holding client money takes three locally based executives and a Jersey compliance officer. Investment business pays 10% tax, and there is no passport.

Two Class A builds

Class A as principal with client money, or as agent without it.

Art. 2(2)(a) treats dealing as principal and dealing as agent alike, so both models sit in Class A. The headcount and the client-money regime change between them; the £25,000 floor does not.

Principal with client money, or agent without it - both Class A.

01 - DEALING AS PRINCIPAL

The market-making Class A firm

A Jersey CFD market maker deals as principal and holds client margin, so three locally based individuals direct it. It keeps £25,000 of share capital and £25,000 of net assets, carries position risk in its Total Requirement and runs the daily client-money calculation of the 2001 Order.

The agency or arranging firm

A firm that buys and sells only as agent, or arranges deals, and is not permitted to control clients' assets needs two locally based directing individuals instead of three (Code 3.1.2). Its capital floor stays at £25,000. Part 2 of the Client Assets Order, on client money, applies only to firms that hold it.

Why Jersey

A £25,000 floor and a fast JFSC, paid for in local staff.

Jersey keeps a broker's balance sheet small and ties its fees to headcount; in return it wants a real team on the island.

✓
£25,000 of share capital

Code 5.1.3 sets the floor for Classes A, B and C at £25,000 paid up, with net assets of at least £25,000 at all times. Above it sits a liquidity test: adjusted net liquid assets of at least 110% of the Total Requirement, recalculated every business day by a firm with position or currency risk.Plus 110% liquidity against the Total Requirement.

✓
Twenty working days

On 10 June 2026 the JFSC cut its service standard for a full investment-business application from 30 working days to 20, and it ties delivery to the quality and completeness of the file. Adding a class later takes 5. Queries are acknowledged within 48 hours and resolved within 10 business days.Service standard since 10 June 2026.

✓
Fees that follow headcount

The 2026 Fees Notice charges £2,910 to apply, then £4,716 a year plus £3,303 for each of the first 15 investment employees and £1,713 for each one after. Five dealers and supervisors put the year at £21,231. The 2027 Fees Notice, already published, sets £2,997, £4,858 and £3,402.£3,303 per investment employee in 2026.

✓
10% tax, none on dividends paid abroad

A registered investment business pays 10% as a financial services company. A joint ministerial statement of 17 April 2026 confirms that Jersey charges no capital gains tax and no tax on dividends paid to non-residents.Nothing on dividends to non-residents.

✓
Disclosure instead of leverage caps

Jersey's Code sets no retail leverage limit, negative balance protection or close-out rule. It requires written margin terms that spell out what follows a missed margin call (2.27-2.28), and a risk warning on every advert inviting investment in CFDs and other higher-risk products (7.13).Margin terms and CFD risk warnings.

✓
Warning: six eyes and a track record

Three locally based individuals must direct a firm allowed to control clients' assets, and directors who are not locally based do not count. The JFSC's starting point is a 3-year supervised record, and the managed-entity route that trust and fund businesses use is closed to investment business.Six eyes, local control, 3-year record.

How it compares

How Jersey differs from other routes.

A UK, Cypriot or Maltese market maker holds £750,000 or €750,000 of capital; a Jersey one starts from £25,000 and pays 10% tax against 25% in the UK and 15% in Cyprus. Malta's 5% effective rate is lower still. What Jersey does not give is market access: no EU passport, no UK permission, and no leverage cap or negative balance protection in the Code to point to.

Forex license requirements in Jersey: what the JFSC checks.Jersey forex license requirements.

The JFSC tests an application against Articles 8 and 9 of the 1998 Law, the Code of Practice for Investment Business and its licensing policy. A Class A file passes when it answers these ten points.

01
Scope - Class A, dealing in investments as principal or agent under Art. 2(2)(a) of the Financial Services (Jersey) Law 1998, with each product on the list confirmed against Schedule 1 before filing.
02
Capital - £25,000 of paid-up share capital and net assets of £25,000 at all times (Code 5.1.3); share premium counts only where the JFSC agrees (5.1.5).
03
Liquidity - adjusted net liquid assets of at least 110% of the Total Requirement, whose expenditure, position-risk and counterparty-risk parts are calculated daily, with immediate notice to the JFSC below 130% (Code 5.1.6-5.1.7).
04
Insurance - professional indemnity with fidelity and D&O cover, its limit at least the greater of £1,000,000, three times relevant fees and commissions or 10% of controlled assets (Code 5.2).
05
Executives - three appropriately qualified, locally based individuals directing a firm that controls clients' assets, or two where it does not, and never a board made up solely of close family (Code 3.1.2).
06
Key persons - a compliance officer based in Jersey (Code 3.5.4) plus an MLRO and an MLCO under the Money Laundering (Jersey) Order 2008; one person may hold all three roles where volumes allow.
07
Board and records - local management and control, which the licensing policy treats as shown in most cases when the balance of the board is resident in Jersey and active in governance, natural persons only as directors, and records readily accessible on the island (licensing policy 9.5-9.6).
08
Track record - 3 years as a supervised firm, the applicant's own or its immediate parent's, as the JFSC's starting point (licensing policy 4.1), with personal questionnaires from every principal and key person (13.7).
09
Client money - client bank accounts opened before money arrives, a bank trust letter copied to the JFSC, payment in by the next business day and a monthly reconciliation (Client Assets Order 2001, Arts. 6, 7 and 10).
10
Promotion and complaints - a risk warning on every advert inviting investment in CFDs (Code 7.13), and a complaints procedure that ends at the Channel Islands Financial Ombudsman (CIFO), whose binding awards reach £150,000.

FAQ

Jersey registration: the questions founders ask first.

What licence does a forex broker need in Jersey?+

A JFSC registration for Class A investment business under the Financial Services (Jersey) Law 1998; Jersey has no separate forex or CFD class. Class A covers buying and selling investments as principal or agent and arranging deals, and the certificate the JFSC issues is what its own policy calls the licence.

How much capital does a Jersey CFD broker need?+

At least £25,000 of paid-up share capital and £25,000 of net assets at all times, with adjusted net liquid assets of at least 110% of the Total Requirement (Code 5.1.3). The JFSC can raise the bar under its risk-based supervision, so we model the Total Requirement before filing.

Does the JFSC expect a track record?+

Yes. Its licensing policy starts from a 3-year record as a supervised firm, either the applicant's or its immediate parent's. A start-up can put forward its shareholders' and directors' own experience instead, and owners connected with a higher-risk jurisdiction should expect to show a longer record.

Who has to be based in Jersey?+

Three locally based, qualified individuals must direct a firm allowed to control clients' assets, two if it is not. The compliance officer is based in Jersey, a board whose balance lives there is the usual proof of local management and control, and records stay accessible on the island; investment business cannot use the managed-entity route.

How long does a forex license in Jersey take?+

Twenty working days for a full investment-business application under the JFSC's service standard, cut from 30 working days on 10 June 2026; the JFSC says higher-impact or complex files take longer, and Articles 8 and 9 of the Law set no deadline of their own. Hiring the local team comes first, so we plan for 4-6 months end to end.

What does a forex license in Jersey cost?+

In 2026 the JFSC charges £2,910 to apply, then £4,716 a year plus £3,303 for each of the first 15 investment employees. Capital starts at £25,000 and PI cover at £1,000,000. Jersey salaries and premises, the largest lines for most budgets, are confirmed in the quote.

Does Jersey cap retail leverage?+

No. The Code of Practice for Investment Business has no leverage limit, negative balance protection or margin close-out rule. It does require written margin terms and risk warnings on CFD adverts, and the JFSC weighs the intended customer base and Jersey's reputation when it decides on registration.

Can a Jersey firm sell into the UK or the EU?+

Not on the registration alone: it carries no passport to the UK or the EU, so each target market's own rules decide, and we check them country by country. The Code adds a duty of its own, to apply the Jersey framework abroad and raise significant host-state differences with the JFSC.

Jersey or the UK for a CFD market maker?+

The UK, if the clients are British retail: FCA authorisation is what that market and its banks recognise, at £750,000 of own funds for dealing on own account and 9-15 months of review. Jersey asks £25,000 of share capital and 10% tax against the UK's 25%, but grants no UK access.

Why Prifinance for Jersey?+

We start with the track-record question, because it decides whether the JFSC file is worth building, and we hire and document the Jersey team before drafting. The application, the client-money set-up and the JFSC's queries run through our St Helier office.

What licence?+

JFSC Class A registration.

Capital?+

£25,000 plus 110% liquidity.

Track record?+

3 supervised years as the start.

Who lives in Jersey?+

Executives, compliance officer, usually a board majority.

How long?+

20 working days; 4-6 months planned.

Cost?+

£2,910 fee; £4,716 a year plus per head.

Leverage cap?+

None; disclosure rules apply.

UK or EU access?+

No passport.

Or the UK?+
