South Korea regulates virtual assets in two layers. Since 2021, a virtual-asset service provider must register with the Korea Financial Intelligence Unit, KoFIU, under the Act on Reporting and Using Specified Financial Transaction Information - the country's AML statute. On top of that, the Virtual Asset User Protection Act came into force on 19 July 2024, adding real user protections: segregation and safekeeping of client deposits and assets, cold-storage and insurance-style requirements, a ban on unfair trading such as price manipulation, and broad supervision, inspection and sanction powers for the regulators.
We will be honest about what makes Korea hard, because it is not the form-filling. Registration requires an Information Security Management System certification - a demanding technical audit - and, for a fiat-enabled exchange, real-name verified deposit-and-withdrawal accounts issued by a Korean bank. Banks grant those sparingly, and that single condition is why only a handful of exchanges operate at full scale. This is not a jurisdiction you buy into quickly.
