Mexico regulates virtual assets through the 2018 Law to Regulate Financial Technology Institutions - the Fintech Law. Only Financial Technology Institutions authorised by the CNBV may operate with virtual assets, and the process requires prior authorisation, AML and KYC controls and prudential standards. Crucially, Banxico - the central bank - reserves the right to decide which virtual assets are permitted in the financial system, and has used secondary rules to limit crypto as a means of payment and protect financial stability. Regulated financial institutions cannot offer virtual assets directly to clients without prior authorisation.
The honest picture is a large, engaged market with a narrow licensed route. Individuals and unregulated businesses transact crypto, but the authorised financial-institution path is deliberately restrictive, and Banxico's stance keeps it that way. A Fintech Law 2.0 is being discussed, which may reshape the framework.
